    Thomas and Scalia have a separate concurrence in Gonzales v Carhart saying the Commerce Clause issue was indeed before the Court. And O'Connor's dissent in Raich makes a big deal about the Tenth Amendment and the police power of the states in the context of medicine.

    NFIB v Sebelius says you can't put new strings on old money allocations.

    Solid point from Sarah about Trump favoring former Trump-critics turned Trump-sycophants (my phrasing, not her's). Aka, people who surrendered their will for him (whether it be for political or professional purposes). I've thought about this a number of times, but don't think I've ever written about it.

    Scott Peterson is doing time (life in prison without parole) for a double murder - his wife and unborn child. Mr. Peterson was originally sentenced to death back in the early 2000s.

    JD Vance wasn't famous? Okay, he had a huge, best-selling book about Ohio but maybe that would not make him "famous" because it is a book. But that book was turned into a hugely publicized Netflix movie. Granted it was unwatchable (even by Netflix standards) but that would have played in Ohio.

    Maybe he didn't have the Oprah-induced fame of Doc Oz but JD Vance still had big name recognition.

    The thing I don’t think even reasonable good faith conservatives acknowledge is that pro-choice supporters see abortion as an issue of freedom, not the “positive aspects” of abortion itself. Few celebrate the removal of a foetus - but we do celebrate the opportunity for women to have as much control over their future as men have always had.

    It’s like saying how weird it is no one really celebrates chemotherapy, so it must not be a winning political issue. It’s a health and medical concern - personal, private, and essential to having equal opportunity for 50% of any population.

    And yeah, US progressives are worried about all the other issues good faith conservatives, along with the conservative Supreme Court justices, claim are almost certainly here to stay. Yknow, like national access to abortion. Remember when all the justices lied about their fealty to precedent? Fool folks once…

    This comment is intended for Jonah. I'm writing it in this podcast comment section because I'm hoping he will see it (or one of the others on the show will see it and point him towards it). I think the reason for that will be clear at the end of the post. It has nothing to do with Roe v Wade or the leak or the other topics of the day. But I thought it was important to write.

    In 2009, I was working in an pediatric ICU in the mid-west (I can identify exact names and locations but I'm avoiding that to protect privacy). An 8-year old boy came in with a relatively bizarre complex of symptoms. We identified some unexplained bleeding around his spinal cord and he became desperately ill and his life was in severe jeopardy. We slowly started to make progress on his recovery, but he was very ill with us for several months, and then convalescing for several more.

    In the convalescing months, I noticed that there was an autographed picture in his room, directly under his TV. I realized immediately it was the FoxNews crew from the 6pm ET show - I have no idea what the show's official title was back then. The picture had Bret Baier, Jonah, Charles Krauthammer and another person (I can't recall which person, I assume Juan Williams but somehow think that is not right). I asked this precocious 8 year old why he had this picture, and he said he was a big fan of the show and all of the people in the photo. His dad told me that he had written to the show while his son was in the depth of his illness --- and the photo arrived and was considered a good luck charm.

    I told the child and his dad that I was also a big fan of all of the folks in the photo (a conservative in academia!). I had been watching the show for a long time and liked Jonah and Charles and Bret very much and I never missed the opportunity to read a column from them or watch an appearance.

    As a result of his illness, the child was left paralyzed from the neck down. He underwent several procedures to try to increase his mobility, but they were unsuccessful. But his spirit and happiness were undaunted. When he was about to be discharged, I asked him which person in the photo was his favorite. He told me Charles, because "paralyzed guys are cooler than everyone else".

    I promised the family that I would reach out to the good folks who helped out a child in need if I had the chance. I joined the Dispatch recently, which allows me to post this information with some degree of anonymity, at least more than if I posted it on Twitter or other social media. So, I thought this was the appropriate forum.

    Jonah, thanks for helping a child and family you never met before at a time when he needed it the most. All of your work was scrupulously followed by this child and he got a lot of strength from the show and all of your work. Please thank Bret Baier and the Krauthammer family as well, if that is possible. I regret that I did not figure out a way to let Charles know this before he died. But hopefully letting his family know will be of some comfort for them.
