In Monday’s emergency episode of the podcast, David and Sarah bring us up to speed on the Trump legal team’s latest litigation drama, which has become nothing short of a clown show. One of the most puzzling aspects about all of this is the striking gap between the Trump campaign’s public rhetoric about widespread voter fraud during press conferences and its much more modest—albeit still meritless—legal arguments in the courtroom. No matter how you slice it, the president’s legacy is on the line here. In Sarah’s words: “This is what he’s going to be remembered by.” Our hosts discuss the Trump campaign’s failed Pennsylvania election lawsuit and Thursday’s rather unconventional press conference given by Sidney Powell, Rudy Giuliani, and Jenna Ellis. Then Sarah’s husband, Scott Keller joins the podcast to spar with David about nationwide injunctions.

    What about a constitutional amendment that sends certain court decisions to Congress, which must then vote to extend the opinion nationwide, restrict it to the jurisdiction of the court, or pass a different statute that addresses the problem?

    I enjoyed the podcast a lot today.
    One request though ... At some point, could you get into the weeds around the legal issues related to truth (or, more importantly, lies?)
    In the past couple of weeks, Sydney Powell has stated that:
    * One company produces fraudulent software that was initially ordered by Hugo Chavez;
    * Another company has used that software in its voting machines and manipulated that software to change the election;
    * Georgia Governor Brian Kemp took bribes to allow all of this to happen in his State.
    These claims have been widely disseminated. They have even been regurgitated by posters on this site.
    I get all of the First Amendment principles and I understand that there are legal avenues that can be pursued, but these are generally very expensive and rarely worth the victim's time.
    However, we as a society are now buried in conspiracy theories that cause considerable damage to individuals and groups and are blatantly false.
    What's up with that?

    I enjoyed that and got a better understanding of the court cases, especially why what they filed re: amending the complaint, doesn't get them where they want to go, I think by the time I listened to this they lost already. And if I remember right, the district court appeal too?
    And nice to hear from Sarah's hubby too...and congrats on the WSJ piece

    Is it just me or are these podcasts not working well in Safari v. 14.0.1? Used to work fine, but now I just click click click the play button, and nothing happens. I have to open the page in Chrome to listen.

    If I had been the judge in Pennsylvania, I would have been tempted to have borrowed from Billy Madison... "what you have just said is one of the most insanely idiotic things I have ever heard. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this room is now dumber for having listened to it.
