    There might be a more straight forward way (though not necessarily an easy way) to address the police situation. The 14th Amendment has two parts that would be useful (see below). Clean up your act, provide proof (data), or else. Equal protection seems to get violated often.

    Section 1: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

    Section 5: The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

    The current congress has sent many, many bills to the senate. McConnell has used them as seat cushions instead of putting them up for a vote. It's not Congress, it's KIng McConnell. He needs to be gone before we can have a functioning legislature.

    This episode reminds me, Disney Plus currently has the entire Schoolhouse Rock library. I was watching them for a couple hours the other night. After listening to this episode, I can tell I'll need to listen to a couple more hours since I didn't understand some of the grievances. (Hope I didn't just commit some)

    Also I'm not sure why David (and Sarah?) try to drive a wedge between process and outcome. If a judicial philosophy is unreliable for arriving at correct rulings (or if it is so coarse-grained that it can't reliably arrive at the correct rulings), shouldn't conservatives (or anyone) seek a judicial philosophy that is more reliable (or more fine-grained)?

    It seems unwise that applications of principle (case outcomes) not function as feedback for tuning our principle. After all, don't the most common objections to utilitarian thinking arise from looking at the sort of outcomes that it produces? Didn't Plato raise the issue of whether "giving to each what is owed" is a sufficient definition of the principle of justice by looking at the outcome that such a principle might produce if our friend, of unsound mind, us to return the sword he had deposited?

    It looks like two of David's stances are inconsistent:

    @ 52:45-52:55 "It's a lot finer point than the way it's being cast in the public argument like 'Gorsuch rewrote the law!' No, he's he's making a conceptual argument..."

    @ 50:39 "I'm more persuaded by Alito['s dissenting opinion], but it is a lot closer than I thought it would be."

    In short, it's hard to see how one can deny that Gorsuch "rewrote the law" unless they agree with Gorsuch's ruling, but David says that he doesn't agree with Gorsuch's ruling.

    To try and draw out that point, if it's not obvious: (a) David holds that it's not the case that Title VII prohibits discrimination on the basis of sexual orientation. (b) Gorsuch has made it the case that Title VII prohibits discrimination on the basis of sexual orientation. (c) Gorsuch has not changed Title VII.

    Maybe David has some stipulated sense of "rewrote the law" that makes a-c consistent... but it's not immediately obvious to me what that is.

    Preach on Brother Goldberg! Legislatures need to legislate! Legislatures are now pundits, cable pundits are now political advisors. “Y’all, this is putting a stress on our system.”

    Caught the second half on the way home and that was some classic Jonah and David dissertations on the destruction that is allowed to happen while a useless congress stands back doing nothing. I can't call these rants since I think of rants as idle complaints. No, I'm visualizing Abe Lincoln at the Lincoln-Douglas debates as I was listening to these eloquent and powerful calls to action. The Dispatch at it's finest!
    Message to Congress: Do your job!
    Oh, and message to Sarah: You have the perfect baby? I advise waiting 12 to 24 months before making that claim! 😃
